Eligibility for Canadian Citizenship

 

Under the Citizenship Act, an individual is recognized as a Canadian citizen if they meet any of the following criteria:

 

Born in Canada after February 14, 1977.

Born outside Canada after February 14, 1977, with at least one parent who was either born in Canada or was a naturalized Canadian citizen at the time of their birth.

In specific cases, individuals born in Canada before February 14, 1977, or born outside Canada to a Canadian citizen parent before this date, are also considered citizens. Those who have previously lost their Canadian citizenship may also be eligible.

Individuals not meeting these criteria can apply for Canadian citizenship through a grant of citizenship.

 

Dual Citizenship

Canada allows dual citizenship, but not all countries permit this. Therefore, individuals may need to renounce their foreign citizenship upon becoming Canadian citizens.

 

Grant of Citizenship – Application Process

To apply for a grant of Canadian citizenship, individuals must submit a paper-based application, as online applications are currently not accepted. Applicants must demonstrate sufficient physical presence in Canada and their intention to continue residing in the country. Additionally, applicants aged 14 to 64 must prove proficiency in English or French and pass a citizenship test, which covers Canada’s political system, history, and geography. It is crucial to ensure eligibility before applying, as early applications are not refunded if ineligible.

 

Eligibility to Apply for Citizenship

Applicants must have resided in Canada as permanent residents for at least 4 years (1,460 days) within the 6 years immediately preceding the application date. They must also be physically present in Canada for a minimum of 183 days during each of the 4 calendar years. Furthermore, applicants must have filed Canadian income tax returns for at least 4 of the 6 years prior to the application and declare their intention to reside in Canada. Only time spent in Canada as a permanent resident counts towards this requirement.

 

Citizenship for Children

Children under 18 do not need to meet the residency requirement if they are permanent residents and have at least one parent (or legal guardian) who is a Canadian citizen or is applying to become one.
