PROFILE: Troy L. Crossley is associated with the
law from Aldrich, Nelson, Weight & Esplin, one of the oldest and most respected
law offices in Utah.
Troy L. Crossley is a partner in the
firm Aldrich, Nelson, Weight & Esplin. He is a graduate of the J. Reuben Clark Law School,
earning his Juris Doctor in 1996. Subsequent to graduation, Troy spent 1
1/2 years working as a law clerk for the Judges at the Fourth District Court.
This clerkship provided him with valuable experience on the actual workings of
the legal system, and acquainted him with all of the Judges of the Forth
District, and many others throughout the State of Utah. After his
clerkship, Troy worked for the Utah Legal Services, where he represented victims
of domestic violence, as well as the disabled. He left Utah Legal Services in
January 1999 to take his current position. He was born and raised in
Pleasant Grove, Utah, is married, and is the father of three young girls.
He is a member of the Utah State Bar, and is admitted to practice law in the
State of Utah, and in Federal Court.

Areas of Practice:
Social Security/ Disability
Applying for Social Security Disability benefits is a complicated task. What
makes it more difficult is the fact that most applications are initially
rejected.
Please do not give up just because your initial application was denied. The
Government is like any insurance company. They save quite a bit of money by
denying worthy claims, hoping those people will choose not to "fight the
system," and give up without pursuing the matter. Unfortunately, many truly
disabled people will do just that, and never receive the help they need.
Our office has represented disabled clients at every stage of the process,
from the initial application, to civil trials in the Federal Court. We have
extensive experience, and have been extremely successful, in front of the Administrative Law Judges, appealing the
denial of benefits on behalf of our clients. No matter what stage of the process
you are at, we can help you understand and survive the Social Security game.
Social Security Disability cases are pursued on a contingency basis, so there is
no fee charged unless your case is won. Without help, you could wind up at
the mercy of others who do not necessarily have your best interest in mind.
Bankruptcy
If you are considering a bankruptcy, chances are you have been through an
event, or series of events, that have devastated you and your family. You should
not feel embarrassed, or hesitate to seek advice on what options are available
to you. The bankruptcy statutes exist to provide those who have been struck by

Juvenile Court
Juvenile Court has increasingly become a specialty area of law. The rules and
procedures used in Juvenile Court can be much different than those used in other
Utah courts. You can easily feel lost and helpless unless you have a competent

Landlord/ Tenant
Landlord/tenant law is one of the most difficult areas of law for the average
person to understand. Landlords and tenants both have rights and
responsibilities, but each are rarely aware of what these rights and
responsibilities mean.
Landlords have very intricate rules that they must follow if their lease
agreement has been violated by the tenant. Many landlords who proceed through
the eviction process without representation will fail to follow these rules
close enough, causing the Court to deny their request, and even possibly issue
sanctions.
Tenants are usually unaware of these intricate rules as well, and have no
idea whether or not the actions of their landlord are appropriate. Furthermore,
tenants are rarely informed of the duties a landlord has to provide a safe,
comfortable environment.

Expungements
In today’s society, it is becoming terribly important to maintain a clean
criminal record. An increasing number of agencies, including employers, have
access to this information, and will search these records before making
personnel decisions. If you have a criminal record, you may be eligible to have
it expunged, or erased. Once a criminal record is expunged, you can legally and
honestly answer “no” when asked if you have been convicted of a crime. The

Estate Planning
Every person should, at the very least, have a will prepared to guide loved
ones if something unexpected were to happen. You can name guardians for your
children, give away specific items of personal property, give instructions
for your burial, and dispose of other assets through a simple will.
Many
people also want to remove weighty decisions from the shoulders of their family
by creating a living will. A living will is a document that gives instructions
to medical providers about what efforts you would like them to make to prolong
your life after all hope of recovery is lost.

Defective Products
If you have been injured from using a product which had been advertised as
safe, you may be entitled to compensation. The government, as well as other
consumer groups, require warnings to be issued by manufacturers in a manner
which will allow you to make an informed decision as to whether or not you wish
to use the item. Sometimes, those warnings are not adequate, not noticeable, or
all to often, simply withheld from the public. If you believe you have been

Fen-Phen was one such product over which there is ongoing litigation. While many
deadlines have already passed, there are still some claims that can be made if
you have already registered with the class-action suit. We can help you pursue

several different areas of law. Our office has handled many types of cases that
are not included in the list to your left. If you don't see your case in the

Rates & Fees:
You will find that most attorney's will not give you price information on
their web sites. There is a good reason for this. Every case is unique, and will
require a different level of commitment from the attorney in order to provide
you with the proper representation. It is very hard to quote a fee for a case
until the attorney hears the facts. There are some exceptions, which will be
listed below.
Depending on the type of case you have, you will be billed one of three ways:
1. Flat Fee. A flat fee is a single fee that the attorney charges to
pursue a case. Once paid, the attorney will see your case through to the end, no
matter how much work is involved. The flat fee charged depends on the type and
complexity of the case. Only some cases are offered as flat fee cases. While it
is not possible to quote a flat fee without hearing the facts of the case, there
is an exception when it comes to Chapter 7 Bankruptcies. Our office will pursue
these cases for a flat fee of $800 (that includes the filing fee), provided
there are no contested debts in the matter.
2. Hourly Rate. Most clients will pay an hourly rate for the services of
an attorney. Hourly rates that attorney's charge can vary greatly depending on a
number of factors. For all cases to which an hourly rate applies, our office
charges $100 per hour for all work done.
3. Contingent Fees. Some cases are done on a contingency basis. These are
cases where you do not pay legal fees unless the case is won or settled in your
favor. Obviously, contingency cases are those in which a successful conclusion
will involve money being recovered for you, such as an injury case. The standard
contingency fee charged by our office (which is the standard in the industry) is
onethird of the final award. The exception to this are Social Security
Disability cases, where the Federal Government regulates the fees that can be
charged. The standard fee in those cases is 25% of the arrears due up to a
maximum of $4000.

Members:
As part of our
commitment of service to the community, our office is affiliated with the ARAG
Legal Insurance group. We gladly accept most cases covered under your ARAG
policy.
Outside
Utah
County:
Our office services the
entire state of Utah. We realize it can be very difficult to obtain competent
legal help in remote areas of the state. On most cases, we will not charge an
increased fee to represent you anywhere in the State.
